DESCRIPTION:  \n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\nVITAL hearing on LD489 Monday 2/25 at 9am\, Burton Cross Office Building room 214 at the State Capitol in Augusta. You need to stand up and be heard\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\nLD 489 is a bill titled “An Act To Allow Municipalities to Enforce New Noise Ordinances on Existing Shooting Ranges”.   Gun clubs and ranges in the state will be at risk.\n LD489 guts it by making the existing law subject to a new subsection.  The new subsection\, the meat of LD489\, says:\n \nA municipality may adopt a noise control or other ordinance that applies to an existing sport shooting range if the Commissioner of Public Safety approves the ordinance prior to adoption.  The commissioner shall establish the authorization process\, including criteria to allow enforcement of an ordinance to a sport shooting range\, through rulemaking.  Rules adopted pursuant to this section are major substantive rules as defined in Title 5\, chapter 375 subchapter 2-A.\n \nIn other words\, a municipality can adopt an ordinance – any ordinance it wants – to govern any sport shooting range.  Like yours.\n \nWhile the title of the bill says “new noise ordinances”\, the language of the bill says “noise control or other ordinance”.  A town could decide any range had to have “no blue sky” (at the club’s cost\, of course).  Or ban anything larger than .22 rimfire.  Or prohibit steel targets.  Or limit shoot times.  Or ban ranges outright.\n \n\nThe public hearing on this bill before the State and Local Government committee is currently scheduled for 9 am Monday\, February 25 in room 214 of the Cross Office Building at the State Capitol in Augusta.
